Employer Practices Liability Insurance

Statistically, there's a growing risk that threatens your business, unless you work solely alone. It's the risk that you'll be the target of legal action from a past, present or prospective employee.

It doesn't matter how many employees you have, how attractive your benefit plan is, or how long your employees have been with you. As an employer, you are at risk. According to USA Today, an estimated 450 employment lawsuits are filed in the United States every day.

Now, the ARA Insurance Services, Inc., has an insurance plan to minimize your business risk. It's the Employee Practices Liability Insurance program to reduce the exposure of your business to claims by employees.

The policy covers a wide range of employment-related claims and offers a loss prevention program to help minimize risks. It's the most comprehensive employment practices liability policy on the market today for the small-business owner!

Among the risks covered are:

  • Wrongful termination claims. The discharge of an employee has more potential to result in litigation than any other aspect of the employee relationship. This policy covers claims by former employees that they were wrongfully terminated. It also covers claims by former employees that they resigned because they could not tolerate the work environment.

  • Discrimination claims. The insurance covers claims by current, former or prospective employees who charge that they are the victims of discrimination on the basis of race, age, disability, religion, sex and other reasons prohibited by law.

  • Sexual harassment claims. It covers sexual harassment claims against your company, including claims against supervisors and fellow employees, in all categories of harassment currently defined by the Equal Employment Opportunity Commission.

  • Whistle-blower claims. The policy covers claims by employees who charge that they were the subject of an adverse employment decision solely because they disclosed an unfair or illegal practice by an employer.

  • Other employment-related claims. Other causes of action alleged in employment litigation are covered, including libel, slander or other defamation, invasion of privacy, mental anguish, infliction of emotional distress, loss of consortium, assault, battery, breach of contract, negligent hiring, supervision, promotion or retention in connection with any other employment-related claim.

The policy has a "duty to defend" feature that provides you with legal representation as soon as a covered claim is presented, even if the allegations are groundless, false or fraudulent.

It provides coverage for any written notice you receive or any administrative proceedings initiated against you seeking to hold you responsible for a wrongful employment practice.

It also includes coverage for your company's directors, officers, owners, partners and spouses for conduct within the scope of company duties, as well as coverage of claims against employees.

You'll also benefit from a loss-prevention handbook that summarizes the key laws that affect employee relations, sample policy statements and forms, and updates on legal developments in the employment field.
